Preamble
LE CHEMISEUR® offers custom-made shirts and trousers through its website and its showroom in Paris.
By placing an order (hereinafter “Order”), the Client acknowledges having read and accepted without reservation these General Terms and Conditions of Sale (T&C), in accordance with Article L.111-1 of the French Consumer Code.
The Company reserves the right to modify the T&C at any time without notice. The applicable T&C are those in force on the date of the Order.
Article 1 – Custom-Made: Fit Guarantee

Fit Guarantee for the First Item
If the fit of your first shirt or trousers does not suit you, LE CHEMISEUR® will alter or remake it free of charge, for 100 days after delivery.

No Right of Withdrawal
In accordance with Article L.221-28 of the French Consumer Code, there is no right of withdrawal for personalized products. Indeed, they are made exclusively to your measurements and cannot be resold to other customers.
Article 2 – Gift Vouchers and Gift Boxes

Gift Vouchers

Valid for 1 year to create a shirt or trousers, up to the amount indicated at purchase.

If the price of the chosen shirt or trousers is higher, the Client pays the difference. If the price is lower, the remaining balance is credited for 6 months (non-refundable).

Unused PDF Gift Vouchers can be canceled and refunded within 14 days of purchase.

Gift Boxes

This is the physical version of the Gift Voucher, including a measuring tape and fabric samples.

The Gift Box can be returned within 14 days if it has not been used. Return postage costs remain the responsibility of the Client.
Article 3 – Order

Legal Capacity
To place an Order, the Client must be of legal age and legally capable of entering into a contract.

Order Process

Creating an account and providing the necessary measurements or information (weight, height, etc.).

Choosing the fabric, style, and finishes.
-
Validating the Order and accepting the T&C.
-
Secure payment.
-
Order confirmation by email (the sale is then considered final, unless canceled for legitimate reasons).

In-Person Orders
The Client can also place an order at the showroom. These T&C apply.

Availability
Products and fabrics are offered subject to stock levels and production capacity. In the event of unavailability, the Client will be notified by email. He may choose an equivalent fabric or be refunded.
Article 4 – Pricing and Payment

Pricing

Prices are shown in euros, all taxes included (TTC).

For deliveries outside the EU, such as Switzerland, prices are recalculated net of tax at the last step before payment (VAT deducted). Customs duties may apply according to the legislation in force in the destination country and are payed for by the Client.

Payment

By credit card (Visa, Mastercard, Apple Pay) via a secure system provided by PayPlug.

The Client warrants they are authorized to use the card and have sufficient funds.

The Company reserves the right to suspend or cancel the Order in the event of a payment issue.
Article 5 – Delivery

Delivery Times

We do our best to provide a reliable estimated delivery time on the Site and to meet it, taking into account the workshops’ workload and operational constraints.

In the event of force majeure, these deadlines may be extended.

A delay does not entitle the Client to a refund, but a commercial gesture may be granted, please contact us.

Shipping Fees

They are indicated when placing the Order and on the delivery page.

Progressive Shipping

For a first Order containing multiple items, we will initially ship one item at no additional cost to validate the fit before producing the rest.
Article 6 – Delivery or Quality Issues

Inspection upon Receipt
The Client must check the condition of the parcel upon receipt and report any anomaly within 48 hours (damaged parcel, quality issue, etc.). To benefit from the Fit Guarantee , you have 100 days. Take your time to wash and wear the garment several times so you can be sure of what adjustments are needed.

Quality Concerns
If the Client notices an issue with an item, event though they followed the care instructions, they must contact the Company. The latter may request a return (at its own expense) for analysis, and will proceed with a repair, a replacement, or a refund. The Company’s liability is limited to 6 months for such claims.
Article 7 – Personal Data
The Company collects and processes your data to manage the commercial relationship and carry out the Order, in compliance with the GDPR.
You have the right at any time to access, rectify, object to, or delete your data by contacting customer service at lecontact@lechemiseur.fr.
The Company filed CNIL declaration no. 1757026v0 on 04/08/2014.
Article 8 – Liability

Limits of Liability
The Company cannot be held liable for any incorrect input of measurements or customizations by the Client, or for improper use of the product.
Events of force majeure may delay or prevent execution of the Order.

Observed Non-Conformity
In the event of non-conformity attributable to the Company, it may propose repair, replacement, or refund.
Article 9 – Intellectual Property
All elements featured on the Site (texts, illustrations, logos, trademarks, etc.) are protected by French and international laws on intellectual property. Any reproduction, even partial, is strictly prohibited.
Article 10 – Retention of Title
Products remain the property of the Company until full payment has been received (fees, taxes, and mandatory contributions included).
Article 11 – Proof and Security
The computerized records of the Company and its service providers serve as proof for all transactions (Orders, payments, etc.). The Client must keep their login details confidential.

Article 13 – Disputes and Governing Law
These T&C are governed by French law. In the event of a dispute, the parties shall first seek an amicable solution. Failing that, the competent court in Paris shall have exclusive jurisdiction.
